The organiser, operator, and data controller of the Prize Games (hereinafter: “Prize Game”) is Márka Üdítőgyártó Kft. (registered office: H-6055 Felsőlajos, Márka ipartelep 1., hereinafter: Organiser).

Mechanics of the Prize Game and conditions for participation 

Mechanics of the Prize Game

The Organiser announces a Prize Game on the Facebook page of Adrenalin Energy Drink based on the rules set out below. The game is called “LET’S PLAY”.

During the Prize Game posted on the Facebook page of the Organiser, users can enter the Prize Game by commenting under the Facebook post inviting to participate in the Game. By commenting, you agree to be bound by the Terms and Conditions of the Prize Game, and thereby you enter the specific Prize Game and participate in the game.

The prize game will run for the period specified in the description. Comments made subsequently will no longer be included in the game.

The Operator will then draw 1 winner from those who have submitted the correct answer in a comment under the published post inviting to participate in the game within the time period specified, in accordance with the invitation. The draw is automated and not open to the public.

Conditions for participation:

Only individuals over 14 years of age with a Facebook profile registered with real data can participate in the prize game. Participation in the game is conditioned upon completion of the task included in the promotion mechanism set out in Point 2 and acceptance of and compliance with these terms and conditions.

Exclusions

Executive officers, employees, and agents of Márka Üdítőgyártó Kft. cannot participate in the Prize Game, as well as close relatives of the above-listed persons referred to in Point b) of Section 685 of the Civil Code of Hungary.

The Organiser reserves the right to unilaterally modify or terminate the terms and conditions contained in these rules or the prize game itself, even during the duration of the prize game. Any changes to the rules and notifications of possible termination of the prize game will be published by the Operator on the Adrenalin Energy Drink Facebook page. It is the players’ responsibility to be properly informed about the above.

Participation in the Prize Game is voluntary and free of charge, with the option to withdraw throughout the duration of the promotion. Participation means automatic acceptance of these official rules and the Privacy Statement.

 Selecting the winner 

The Operator will draw 1 winner from those who have submitted the correct answer in a comment under the post published on the Facebook page of Adrenalin Energy Drink, inviting to participate in the game, within the time period specified. Within 3 working days of the announcement of the results, the winner must contact us with their name and address by email. If the winner does not contact us within this period, the Operator will draw a new winner.

Conditions for receiving the prizes

Prizes won are non-transferable and cannot be converted into cash.

The winners will be contacted by the Operator via Facebook, as the exact details of the winner’s postal address are required to deliver the prize within 3 working days of the request.

Neither the Organiser nor the Operator assumes any liability for any damage or consequences caused by incorrect of erroneous data provided by the Applicant.

Prize payments related to the Prize Game

Players participating in this promotion are not liable to pay any personal income tax and/or duties in relation to the prizes, these are borne by the Organiser. The Organiser is responsible for the postal costs of delivering the prizes to the winners. Any other costs and expenses that may arise in connection with use of the prizes are borne by the winning Players.

Privacy policy

The purpose of the data processing is to enable the Data Controller to ensure the participation of the Player in the prize game and to process the personal data of the Players in connection with the conduct of the Prize Game and the delivery of the Prizes.

The legal basis for processing is the express, voluntary, and informed consent of the Player. The Player consents to the processing of data as set out in Point 2 by participating in the Game. Those who participate in the Game expressly consent to the Organiser, as the data controller, processing their personal data solely in connection with the specific Game, during the conduct of the Competition, and for purposes of contact and administration, and in the event of winning, the Organiser will publish their names on the Adrenalin Energy Drink Facebook page without any further conditions and without any further consideration, solely in connection with the specific Game.

During the data processing, the Organiser processes the following data of the Player: full name, email address, Facebook ID, in case of winning: address, telephone number.

The duration of the processing is the duration of the specific Game. In case of winning, the data of the winning players will be kept for 5 years after the prizes have been delivered.

The Organiser will use the assistance of a Data Processor in the conduct of the Game. The data processor performs certain technical operations on the personal data processed. During the Games, the Operator, as the data processor, has access to the Player’s personal data. The personal data of the winning Player may also be forwarded to any postal or courier service providers used in the course of the Game for the purpose of delivering the prizes.

The Organiser, as the data controller, shall process the Player’s personal data in accordance with the Hungarian and European Union legislation in force, i.e. in accordance with the provisions of Act CXII of 2011 on Informational Self-Determination and Freedom of Information and of the General Data Protection Regulation (the so-called GDPR).

The Player, as the data subject, has the following rights in relation to data processing:

Right of access

In the context of the right of access, the Player may at any time request information from the Data Controller about the processing of their personal data, access to such data, and request information about whether and what personal data relating to them are processed by the Data Controller.

Right to rectification or erasure, right to restriction of processing.

The Player shall have the right to request that the Data Controller correct or rectify any incorrect, inaccurate, or incomplete data or to request the deletion of their personal data. If the Player requests the restriction of the processing of personal data, the Data Controller may restrict the processing in accordance with the request. If the Player disputes the accuracy of their personal data, the period of restriction shall be applied to the period of time that allows the Data Controller to verify the accuracy of such data. The Player may request the restriction of the use of personal data if the processing is unlawful, but opposes their deletion. The Player may also make such a request where the Data Controller no longer needs their personal data for the purposes of processing, but the Player requires the restriction of processing in order to establish, exercise, or defend legal claims.

Right to data portability;

(In the context of the right to data portability, the Player has the right to receive the personal data provided to the Data Controller in a structured, commonly used, machine-readable format and the right to transmit such data to another Data Controller, even directly, without being prevented from doing so by the Data Controller.) 

Right to the revocation of consent

The Player may revoke their consent to data processing, in whole or in part, at any time, however, the revocation of consent shall not effect the lawfulness of the processing carried out on the basis of the consent prior to the revocation.

 If the Player detects a violation of their rights in the processing of their personal data, they have the following options:

– may contact the Data Controller directly by post or email;

– may take legal action in case of unlawful processing of their data and breaches of data security requirements. The Player may be entitled to compensation and grievance fee. Information on the jurisdiction and contact details of the court can be found on the following website:

Participation in this Game and the provision of data in connection with the participation is voluntary, however, if the Player does not consent to the processing of their personal data, they cannot participate in the Game. If the Player requests the deletion or restriction of their data during the Game or before the prize is delivered, or revokes their consent to data processing, they will be excluded from the Game.

Disclaimer

None of the companies involved in the organisation of the Prize Game is liable for, and excludes all claims for, indemnification and compensation for costs, damages and losses in connection with the Prize Game.

If the player submits any content without authorisation, the Organiser will exclude the player from the Prize Game. The Organiser or the Organiser’s Agent shall not be liable in any way for any unauthorised content or incorrectly submitted data. The companies involved in the organisation of the Promotion and their senior managers and employees exclude liability for any defects in the prize items, unless the exclusion of liability is expressly prohibited by the provisions of the laws of Hungary.

If the winning Player does not collect their prize, they may no longer claim it from the Organizer or the Operator.

The data of the participants are not processed by Facebook, and the competition is not sponsored, approved, or administered by or associated with Facebook in any way.

The organisers are not responsible in any way for the conduct of the players or other Facebook users in connection with the Prize Game. The Organisers reserve the right to moderate any unlawful or ethically unacceptable user comments without giving reasons.

The Organiser shall not be liable for any consequences caused by incorrect of erroneous data provided by the applicant.

The Organiser shall not be liable for problems resulting from technical errors.

By uploading their content, the players acknowledge and agree to all the terms and conditions set out in these rules.
